These Terms govern use of swarthealth.com and purchases from the Swart Health retail store. The store is operated by Swart Group LLC, a New Hampshire limited liability company.

By using the site or placing an order, you agree to these Terms and the posted Privacy, Return and Refund, and Shipping Policies.

Eligibility and acceptable use

You must be legally able to enter a binding contract in your jurisdiction. You may not misuse the site, interfere with its operation, introduce malicious code, attempt unauthorized access, or use store content for unlawful purposes.

Products, prices, and orders

Product descriptions, prices, promotions, and availability may change without notice. We attempt to present accurate information, but packaging, labeling, color, and appearance may vary.

An order is an offer to purchase. We may decline or cancel an order for product unavailability, pricing or listing error, suspected fraud, prohibited resale, shipping restriction, or another lawful reason. If payment has been collected for a canceled item, it will be refunded.

Applicable product charges, shipping charges, and taxes are disclosed before checkout is completed.

Fulfillment

Products may be fulfilled by manufacturers, printers, or other approved service providers. Separate fulfillment does not change Swart Group LLC’s responsibility for administering the retail order and applicable customer-service obligations.

Product use and health information

Follow all product-label directions and warnings. Store content is general information and product navigation; it is not medical advice, diagnosis, or treatment.

Consult an appropriate licensed healthcare professional for questions involving a medical condition, medication, pregnancy, allergy, procedure, persistent irritation, or an unexpected reaction. Stop using a cosmetic product if an unexpected reaction occurs and seek appropriate guidance.

Clinical services are separate

Retail shopping, educational materials, contact forms, and website use do not create a clinician-patient relationship.

When specifically offered, clinical services are provided separately by Swart Health PLLC under separate eligibility, intake, consent, privacy, and professional terms. Swart Group LLC does not provide clinical care.

Returns and shipping

Returns, refunds, cancellations, shipping restrictions, and delivery matters are governed by the posted Return and Refund Policy and Shipping Policy.

Intellectual property and third-party marks

Site content is protected by applicable intellectual-property law. No license is granted except the limited right to use the site for personal, lawful shopping and informational purposes.

PCA SKIN, CPSH, and other third-party names and marks belong to their respective owners. Their appearance identifies the relevant products or services and does not transfer ownership of those marks.

Disclaimer and limitation

To the extent permitted by law, products and site content are provided without warranties beyond those expressly stated by the applicable manufacturer or required by law.

Swart Group LLC is not liable for indirect, incidental, special, or consequential damages to the extent such limitation is lawful. Nothing in these Terms excludes liability or consumer rights that cannot legally be excluded, including liability for fraud, willful misconduct, or other nonwaivable obligations.
